Simple Battery Defined
Battery is intentional offensive touching, hitting, or striking another person. When there are no aggravating factors at play, such as use of a deadly weapon, serious bodily injury, or domestic violence, battery is called simple or misdemeanor battery.
Pursuant to GA Code § 16-5-23 (2020), a person commits the offense of simple battery when he or she either:
- (1) Intentionally makes physical contact of an insulting or provoking nature with the person of another; or
- (2) Intentionally causes physical harm to another.
Penalties for Simple Battery in Georgia
To charge someone with simple battery, the State must prove the defendant’s intent to touch or strike someone against their will.
Injuries are not a required factor when charging someone with simple battery. The touch or strike does not have to be upon the victim’s body—it can be something that is intimately connected with the victim’s person, such as a purse, wallet, cell phone, etc.
If found guilty of simple battery in Georgia, the penalty is a misdemeanor, and consequences may include jail time up to one year and a fine of up to $1,000. In certain situations, the conviction may be escalated to a misdemeanor of a high or aggravated nature.
